PARK CITY, Utah (AP) – A jury is deliberating in a lawsuit filed after a 4-year-old Utah boy was crushed to death by a 250-pound tombstone while taking pictures with his family.
Lawyers for the family said during a three-day trial that shoddy maintenance left the historic headstone in Park City weak and that the cemetery association failed to warn people about possible danger. The boy’s father testified Thursday about seeing his son trapped under the headstone.
The 1889 grave marker fell when the boy tried to pop out from behind it to make other children smile for the camera. His mother had encouraged him to help entertain the kids.
The Glenwood Cemetery Association says the cemetery was well-maintained and the headstone was stable before the boy started playing on it in July 2012.
